Tôi không đồng tình với quan điểm này của tác giả. Bởi lẽ:
Thứ nhất: Tại khoản 1, Điều 357 Bộ luật Dân sự năm 2015 quy định “Trường hợp bên có nghĩa vụ chậm trả tiền thì bên đó phải trả lãi đối với số tiền chậm trả tương ứng với thời gian chậm trả”. Như vậy, Điều 357 không có quy định phải trả lãi đối với những nghĩa vụ khác được quy định tại Bộ luật Dân sự năm 2015.
Thứ hai: Việc thực hiện nghĩa vụ cấp dưỡng không thể xem giống như nghĩa vụ trả tiền, bởi lẽ nếu tương đồng thì nhà làm luật đã không phải phân biệt “nghĩa vụ cấp dưỡng” với “nghĩa vụ trả tiền”. Do đó, chúng ta cũng không thể xem việc chậm thực hiện nghĩa vụ cấp dưỡng cũng có tính chất như chậm thực hiện nghĩa vụ trả tiền, nên người chậm thực hiện nghĩa vụ cấp dưỡng không phải chịu tiền lãi chậm thực hiện nghĩa vụ theo quy định tại khoản 2 Điều 468 Bộ luật Dân sự năm 2015.
Thứ ba: Theo Luật Hôn nhân gia đình năm 2014, việc cấp dưỡng có thể được thực hiện theo thỏa thuận hoặc nếu không thỏa thuận được thì yêu cầu Tòa án giải quyết. Mức cấp dưỡng và phương thức cấp dưỡng được Tòa án giải quyết và có bản án bắt buộc thi hành.
