Trả lời phỏng vấn BBC ngày 3/1/2014, luật sư Hoàng Văn Hướng, thuộc văn phòng luật sư Hoàng Hưng, nói cả hai bị cáo Dương Chí Dũng và Mai Văn Phúc không thể bồi thường để tránh tử hình vì vẫn chưa nhận tội.
Theo ông Hướng, việc bồi thường, dù là do gia đình tự nguyện hay do cá nhân các bị cáo chủ động, thì đều là “tình tiết khắc phục hậu quả”.
“Nhưng cơ bản là họ có nhận tội đâu mà khắc phục hậu quả?,” ông nói.
“Theo tôi hiểu, nếu căn cứ vào Điều 278 thì các ông ấy bị đưa vào Khoản 4, tức là tội đặc biệt nghiêm trọng và hình phạt cao nhất là tử hình thì tòa đã áp dụng rồi.”
“Hiện nay nếu họ nhận tội theo như cáo trạng quy kết tại án sơ thẩm thì vấn đề bồi thường mới có thể được đề ra.”
Luật sư Hướng cho biết một khi các bị cáo nhận tội thì sẽ được áp dụng tình tiết giảm nhẹ là “thành khẩn khai báo và ăn năn hối cải”.
Sau khi đã áp dụng tình tiết giảm nhẹ này và thêm vào việc gia đình các bị cáo khắc phục tuyệt đối hậu quả hoặc quá nửa thiệt hai do hành vi chiếm đoạt gây ra thì sẽ giúp các bị cáo có hai tình tiết giảm nhẹ, ông cho biết thêm.
“Lúc đó thì hội đồng xét xử cấp phúc thẩm sẽ xem xét”, ông Hướng nói.
“Chứ còn dựa vào Nghị quyết 01 để khẳng định là các ông ấy nộp 5 tỷ rồi được xóa bỏ án tử hình thì tôi thấy không khả thi lắm.”
